If you're both on the deed then it makes it easier. If you're going to sell the house that also makes things much easier. Both of you will have to sign paperwork and the check for the sale will require both your signatures.

Bank accounts are trickier. Hopefully you've both set up separate accounts also so that you're not putting more money than necessary for joint debts into the joint account. My advice is divide the joint account as soon as possible. Continue to pay your half of the joint bills. Be fair and pay those bills that are solely yours.

People almost always fight about things. Try to come to some agreement about who owns what and don't become to attached to them. If possible take care of the house, bills and bank accounts first so that those can't be used as clubs for either of you to beat the other with. As in "if you're taking the Spongebob glasses I'm not signing the paperwork for the house."

Personally I would say 'not thinking about it' can come later. Sorry but this is how people get screwed financially. If you truly want to not get screwed financially now is not the time to get emotional.

------

Also I see that the myth of the "common law marriage" has reared it's ugly head. Common law marriage DOES NOT just happen after a certain amount of time. You both HAVE to agree to it and as the law states "the couple in question must hold themselves out to the world to be husband and wife.." This means claiming to be married in some legal fashion. The test is often "have you filed taxes as a married couple"

Please can we let this myth die???

You were living together for more than one year so you are legally married under common law. You need to speak with a lawyer.

take the dog and yourself to the dog park . I would see that you get half the proceeds from the house since you own it jointly . see an attorney as well . and about the bank accounts your attorney will make sure you get what is rightfully yours. be glad you found this out now and not 15 yrs down the road . be glad you did not marry him if he can walk away this easy then he was not worth having and consider yourself lucky . good luck dear .
